Your mother may have more influence over your father than you in convincing your father to create an estate plan. She should have one as well and she can have hers drawn up independently. My dad refused to have an estate plan for years. He would joke and say he would be dead so why would he care. My mom quietly said to him one day that “nothing says ‘I love you’ more to me (your spouse) than leaving an intestate mess behind while I am grieving your death”. Thankfully, they had an estate plan created within 6 months of that comment because my dad was diagnosed with Alzheimer’s two years later. As POA agent for both when they later became incapacitated, I silently thanked my mom many times.
