Some of the details likely vary by state, but I don't believe in general it is a violation of family medical leave laws to be subject to a layoff while on leave, nor to be fired for causes unrelated to the leave (although if a person wasn't aware of a cause for firing prior to requesting the leave, that would be suspicious).

A catch would be if it appears she was targeted for layoff specifically because she was on leave. If there are other coworkers who do similar work who were not subject to layoff, then that raises the question, but I do not think provides certainty, about whether she was chosen for the layoff specifically because she was on leave. If you do think think was the case, I think the next step should be to request a consultation with an attorney familiar with the labor laws in your state. I'm skeptical there is grounds to sue based on what has been stated so far, so I would not rush into it.

Have any severance benefits been mentioned? That might be a reason get the discussion progressing quickly.
