Personal Finance (Not Investing) • Credit card chargeback for latent HVAC issue?

Dear Bogleheads,

I’d appreciate advice on how to get latent defects on a recently installed replacement HVAC (air conditioning) system rectified.

Asking here because I paid via credit card and wondering if folks think a credit card chargeback might be a means to get the installer to at least return my calls and emails on the subject.

Regarding the HVAC system, I used a credit card to pay the deposit in July 2023 and then the remaining balance when the installation was complete on October 18th, 2023. Since, I’ve had issues develop that were not evident at time of completion. (The HVAC unit throws fault codes when in cooling mode and eventually turning off, and now it’s struggling to raise temperature above 72 degF in heating mode.) In November, the installer made four visits to resolve other punch list items and attempted to fix the aforementioned issues, however the issues remain.

Now, in December, my follow-on calls and emails asking for resolution are being ignored.

So, any advice would be appreciated. Is a credit card chargeback a possibility? If so, what’s the best way to go about establishing and documenting a case for it? Any thoughts on getting a 3rd-party vendor to perform diagnostics? Also, if a credit card charge back is recommended possibility, I’m not looking to chargeback the full amount, just enough to get the HVAC installer’s attention to resolve these latent defects.

DO NOT DO THIS! The contractor will put a lien on your house. You need to file a complaint with the licensing board. There is an established process. Follow it.
