You recognize this is a huge risk, yet you don't want to rock the boat with the sale. This is a seller problem, and IMHO, I wouldn't move forward with the sale until seller corrects the issue. Sales are delayed for multitude of reasons, and this qualifies as a NO GO moment. You will regret if this is not corrected by the seller.
Agree. Owning a home is full of surprises along the way; why inherit a problem? Be prepared to walk and not look back. The seller could/should have fixed this issue if it was easy.
